Before filing for a dissolution in Florida, you and/or your spouse must have resided in the state for at least six months. You may file for a simplified dissolution of marriage in Florida if the following conditions are met:

  • Both you and your spouse have come to an agreement that your marriage is beyond repair.
  • You and your spouse do not have any minor or dependent children together. Additionally, the wife did not have any children during the marriage, nor is she currently pregnant.
  • You and your spouse have worked out how the two of you will divide the things that you both own (your assets)) and who will pay what part of the money you both owe (your liabilities), and you are both satisfied with this division.
  • Both you and your spouse have agreed that neither of you will seek support or alimony from each other.
  • You and your spouse have filed financial affidavits with the court, or you have waived the filing of financial affidavits, and you are both satisfied with the financial disclosures received.
  • By agreeing, you are indicating that you are willing to relinquish your right to a trial and the ability to appeal.
  • You and your spouse are both willing to sign the petition at the clerk's office, individually.
  • You and your spouse can attend the final hearing together. If you don't meet these criteria, you must file a regular petition for dissolution of marriage.
