Legal separation is an alternative to divorce that allows couples to separate without terminating their marriage. In a legal separation, the court intervenes to settle issues such as property division, debt allocation, child custody, and support arrangements, as well as spousal support and restraining orders. However, unlike divorce, a legal separation does not dissolve the marriage. This means that both parties are still technically married, but their finances and living arrangements are separated.
One of the benefits of legal separation is that it allows couples to maintain their religious beliefs, which may prohibit divorce. Additionally, legal separation can protect property from any financial liabilities that may arise from debts or other obligations incurred by the other spouse after the separation.
It is important to note that divorce encompasses more comprehensive arrangements, as it terminates the marriage and divides property and debt in a final manner. Therefore, couples should weigh the benefits and drawbacks of each option and seek professional legal advice before deciding which route to take.
Once the paperwork is filed with the court, and both parties agree (uncontested), the court can sign the decree of legal separation.
A legal separation remains in effect until it is converted to a divorce, dismissed by the petitioner, or one of the partners passes away. However, the conversion of a legal separation to a divorce is only possible after a period of six months has passed since the signing of the decree of legal separation.
