Motion and Order to Convert a Legal Separation to a Divorce

If you filed your Legal Separation in Lincoln County, everything is done through the mail and you will not need to appear in court just as when your legal separation was filed. You must file your Motion & Order to Convert in the same county you filed your legal separation.
Lincoln County. The filing fee is $30.00 to convert and both parties must sign the Order prior to sending it to the court. If only one party wants to convert the other must be served and a telephonic hearing will be set. 6 months must have passed from the day the legal separation decree was signed by the judge.
Other Washington Counties. The filing fee is $20.00 to convert and either party can file the motion and order without the others signature and receive their divorce. 6 months must have passed from the day the legal separation decree was signed by the judge.
All counties charge between $294 - $314, Lincoln County and Wahkiakum County charge an additional $30.00 at the
end of the 90 day cooling off period. Using Lincoln County or Wahkiakum County allows
Washingtonians to not go to court (everything is completed through the mail) and
if there are dependent children they will not have to take parenting classes as
all other counties in Washington State require.
