Description:
Divorce versus Legal Separation; what is the difference?
In a divorce your marriage is dissolved, property and debts
are divided, child residency and support is established and
things like alimony/maintenance and restraining orders are ruled
on. In a legal separation the court does the same thing except
your marriage is not dissolved. Your finances are completely
separated and one of you pays child support for any dependent
children of the marriage. A legal separation protects your property
from any debts your spouse may incur after the separation without
actually getting a divorce from your spouse, which may be against
your religion.
As soon as your paperwork is filed with the court the decree
of legal separation can be signed by the court (so long as both
parties have signed it).
Your legal separation lasts until one of you converts it
to a divorce, the petitioner dismisses it or one of you dies.
The legal separation cannot be converted to a divorce until
6 months have passed since the date of the signing of the decree
of legal separation.
